Why is marijuana illegal when tobacco and alcohol are not?

OR why isn’t marijuana legal if tobacco and alcohol are?
I’ve drank alcohol and I used to smoke pot on a regular basis, and truthfully I don’t understand why they don’t either make marajuana legal (considering many of it’s scientific benefits) or make alcohol/tobacco illegal (since they have no benifits at all, an can only make you sick). At least marijuana can do some good for some people, and it’s not addictive like alcohol or tobacco..

Me and my class were debating about whether these companies can advertise these so called "child-friendly" advertisements. My answer is no, they shouldn’t because regardless of whether it’s child-friendly, it still promotes the concept of tobacco and alcohol. What is your take on it?

Why are alcohol and tobacco not considered class scheduled drugs?

In 1970, the US congress passed the Comprehensive Drug Abuse and Control Act, which created scheduled drugs into 5 categories based on medical use, addictiveness, abuse potential. For instance, schedule I drugs have high potential for abuse, no accepted medical use (for instance LSD, marijuana, ecstasy fall in this category). Both tobacco and alcohol causes changes to the brain and CNS, just as other drugs do. For instance ethyl alcohol binds to GABA receptors and nicotine binds to acetylcholine receptors. I fail to see why these aren’t class scheduled drugs, especially since they are two of the most harmful drugs in our society (according to the CDC in 2005, each year, approximately 438,000 die from tobacco related illnesses and 85,000 die from alcohol related problems while only 17,000 die from illicit drug use).

Can I get punished for selling tobacco/alcohol to someone who resells it to someone younger?

Basically, I own a gas station and I sell tobacco and alcohol ONLY to people who are old enough, but sometimes I notice that the people I sell it to gives them to people outside who don’t look like they are old enough. Will I lose my tobacco/alcohol license for this? Or is the person conducting the transaction only liable for this crime? I live in California.
